Yezdan Izzet is a Solicitor and Partner in our Dispute Resolution Team. She is also the firms’ Complaints Partner.

Her expertise covers a wide spectrum of property disputes including landlord and tenant (commercial and residential), forfeiture and possession claims, rent and service charge recovery, lease renewals (opposed and unopposed) as well as real property disputes such as boundary disputes and right of light claims.

More recently Yezdan has developed into a Right to Light expert as well as developing an specialism in advising clients on Development Disputes, including advice on airspace, rooftop and other additional developments. She has experience of broader litigation matters such as contractual disputes and property professional negligence claims.

Yezdan is known and respected for representing clients in the High Court, County Court and First-Tier Tribunal (Property Chamber) as well as appellate courts. Her approach adapts to occasion and need; she is able to successfully deliver both robust and aggressive as well as pragmatic and non-adversarial stances. She always fights hard to protect the interests of her clients and is known for her pragmatic and determined manner.

Examples of some of the cases Yezdan has been involved in are as follows:-

· Obtaining an urgent interim injunction on behalf of a freeholder of a block of flats in London, to prevent leaseholders from obstructing the freeholder’s planned major works and to prevent a number of the leaseholders from holding themselves out as directors of the freehold company.

· Representing a landlord in a £3m disrepair claim against a head leaseholder of an estate comprising of a number of commercial units.

· Obtaining an injunction on behalf of a freeholder of a residential block of flats, to refrain a leaseholder from carrying out alterations to its property in breach of the lease and using the property as a House in Multiple Occupation (“HMO”).

· Obtaining an order against a commercial landlord for the grant of a new commercial lease to the tenant, and challenging the landlord’s redevelopment plans.

· Obtaining compensation for a client from the Solicitors Regulation Authority in relation to fraudulent action by the seller’s solicitor in failing to redeem a mortgage which prevented the client from being able to register his ownership of the property and successfully dealing with the registration.

· Representing leaseholders in a claim against the landlord in a service charge dispute in the First-tier Tribunal (Property Chamber).

· Obtaining a determination that a property was held on trust by a registered owner for the benefit of our client despite the registered owner stating otherwise.

· Successfully defending an action by leaseholders to prevent rooftop development by a freeholder, and

· Successfully challenging a landlord’s rooftop development plans on behalf of a group of leaseholders.
