Property management can be a complex area. Tenants often complain of their properties being poorly managed. Where problems arise and tenants are dissatisfied with the management by their landlord, its managing agent or even an RTM company, the Tribunal has the power to appoint a manager.
Whilst this may be seen to be a draconian step for a landlord, the right to appoint a manager can be a flexible power.
In some cases, it may be used to remedy management issues such as when a building does not qualify for either the right to manage or freehold purchase. It may also be possible, once an order for the appointment has been made, to use it as a ground for obtaining the freehold at a later date.
