JPC Law Lord Justice Jackson Reform Update - Costs budgeting extended to cases worth up to 10million

Last April, the wide ranging litigation reforms introduced by Lord Justice Jackson brought in costs management rules for all Multi-Track cases that are worth more than £25,000. These rules are exempt for cases in the Commercial Court and those worth more than £2m in the Chancery, Mercantile and Technology and Construction Courts.

The Master of the Rolls has recommended a new £10m upper limit which will apply to all courts with exemption from the rules applying across all courts to cases worth more than £10m.

Costs budgeting will apply automatically to all cases below the threshold unless ordered otherwise by the judge, for example as is usual in lease renewal cases. Judges will retain their discretion to apply the rules to cases above the threshold.
