JPC Law - Property Law: New Commercial Rent Arrears Recovery procedure in place from 6th April 2014

From 6th April 2014, a new regime for recovering rent arrears by taking control of a tenant’s goods will come into force.

The previous procedure known as the right to distrain will be replaced by Commercial Rent Arrears Recovery (“CRAR”) can only be used for commercial premises where there are a minimum of 7 days arrears of rent due and payable under a lease.
