New guidance on enforcement agents entering residential property

The Justice Secretary has recently written to the chairman of the High Court Enforcement Association requesting that the enforcement agents in Tier 2 and Tier 3 areas (ie “High” and “Very High” Covid alerts) should not enter residential properties for the purposes of enforcement, including taking control of goods and carrying out evictions. This will not affect enforcement of writs of control as long as the current Government’s Covid –secure guidance is adhered to and the agents do not physically enter the premises.

This is in addition to the existing guidance that there be a ‘truce’ period between 11 December 2020 and 11 January 2021 when no evictions are to be carried out in England and Wales (subject to exemptions yet to be confirmed).

In light of the ever-changing Covid situation, it is likely the guidance will be reviewed on a regular basis, meaning it is key to stay on top of all the legal updates and emergency legislation.
