Many leases are, by any objective view, defective. For example, the service charges may not add up to 100% of the total costs recoverable or the lease may fail to specify which party should insure the building.

Leases can also be defective due to poor drafting or, in some cases, where development leases are drafted before construction is finished and do not reflect the final layout.

Any party to a lease may apply to vary the lease, including Right to Manage Companies.
